Terms & Conditions

Business Customers

The Homecare Medical Trade Portal is intended for business customers only, including nursing homes, hospitals, clinics, pharmacies, healthcare professionals, charities, and other organisations purchasing goods for business or professional use.

By placing an order through the Trade Portal, you confirm that you are acting in the course of business and have authority to place orders on behalf of your organisation.

Orders

All orders are subject to acceptance and availability.

Once an order is placed, you will receive an acknowledgement email. Acceptance of the order takes place when the goods are dispatched.

We reserve the right to refuse or cancel orders where:

products are unavailable,
  lens
pricing or product information is incorrect,
  lens
payment cannot be authorised,
  lens
we reasonably believe the Trade Portal is being used improperly.

Pricing and VAT

Unless otherwise stated, all prices displayed on the Trade Portal are exclusive of VAT.

VAT will be applied at the appropriate Irish rate at checkout.

We make every effort to ensure pricing is accurate; however, errors may occasionally occur. If a pricing error is identified, we will contact you before processing the order.

Payment

Payment may be made by approved online payment methods or through an authorised Homecare Medical trade account where applicable.

For customers with agreed credit terms, payment is due in accordance with the terms agreed for that account.

Delivery

Delivery times provided on the website are estimates only and may vary depending on stock availability, supplier lead times, and delivery location.

Risk in the goods passes to the customer upon delivery to the address provided with the order.

Any shortages, damaged items, or delivery discrepancies should be reported to sales@homecaremedical.ie within 48 hours of delivery.

Product Use

Homecare Medical supplies a wide range of healthcare, mobility, daily living, incontinence, hygiene, and related products for professional and business use.

Customers are responsible for ensuring that products are suitable for their intended purpose and are used in accordance with any instructions, packaging, labelling, or guidance provided by the manufacturer or supplier.

Product descriptions, specifications, images, and availability information are provided for general guidance and may be updated or changed without notice.

Returns

As this Trade Portal is intended for business customers, orders are not subject to the consumer 14-day cancellation right.
Returns may be accepted only where:

the goods are faulty,
  lens
the incorrect item was supplied, or
  lens
a return has been authorised by Homecare Medical in advance.
For hygiene, safety, and product integrity reasons, the following products cannot be returned unless they are faulty or supplied in error:
  lens
incontinence products,
  lens
opened hygiene or personal care products,
  lens
sterile or sealed consumables that have been opened,
  lens
nutritional or healthcare consumables,
  lens
specially ordered, customised, or non-stock items,
  lens
products that have been used, worn, washed, or installed.
Authorised returns must be unused and in their original packaging where reasonably possible.

Faulty or Damaged Goods

If goods are delivered damaged, defective, or incorrect, customers should notify Homecare Medical within 48 hours of delivery by contacting sales@homecaremedical.ie.
Where a product is confirmed to be faulty or incorrectly supplied, Homecare Medical will, at its discretion:

replace the product,
  lens
repair the product where applicable, or
  lens
provide an appropriate refund or credit.
Some products may be covered by a manufacturer’s warranty, but warranty coverage is provided only where expressly offered by the manufacturer or supplier and is subject to the relevant manufacturer’s terms and conditions.
Nothing in these Terms gives a warranty or guarantee that applies to all products supplied by Homecare Medical.

Limitation of Liability

To the fullest extent permitted by Irish law, Homecare Medical shall not be liable for any indirect or consequential loss, including loss of profits, business interruption, or loss of opportunity arising from the use of goods supplied through the Trade Portal.
Nothing in these Terms excludes liability that cannot legally be excluded under Irish law.

Data Protection

We process personal and business contact information in accordance with our Privacy Policy and applicable Irish and EU data protection legislation, including the General Data Protection Regulation (GDPR).

Governing Law

These Terms & Conditions and any contract between Homecare Medical and the customer are governed by and construed in accordance with the laws of Ireland.

Any disputes arising out of or in connection with these Terms & Conditions, or any order placed through the Trade Portal, shall be subject to the exclusive jurisdiction of the Irish courts.
